Income Tax Exemption for Welfare Counselling - Legal & Financial Advice

We are pleased to advise that the Employee Assistance Professional Association UK (EAPA UK) has now successfully reached an agreement with HM Revenue and Customs (HMRC) on how the provision of an EAP can work within the existing tax exemption under welfare counselling. EAPA UK is the professional body for Employee Assistance Programmes (EAP) and it represents the interests of professionals concerned with employee assistance, psychological health and wellbeing in the UK.
 
The outcome of this long negotiation between EAPA UK and HMRC is that the industry must have tighter guidelines on exactly how Legal and Financial information is delivered within EAPs, but it is now free to continue to deliver this as part of an EAP package.
 
The key to the eventual conclusion was around how Legal and Financial information is delivered and what level of information is provided. This is outlined within the attached guidance note which has been developed in conjunction with HMRC by the EAPA UK executive committee.
